1. INTRODUCTION
These Customer Terms and Conditions ("Terms") govern your use of the BiryaniHub platform located at biryanihub.co ("Platform"). The Platform is an online marketplace that connects customers ("You," "User," or "Customer") with restaurants and food vendors ("Vendors") for food ordering and delivery services.
PLEASE READ THESE TERMS CAREFULLY BEFORE CREATING AN ACCOUNT OR PLACING YOUR FIRST ORDER. BY COMPLETING REGISTRATION AND CLICKING "I AGREE," YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.
2. CUSTOMER ELIGIBILITY
2.1 Legal Requirements
You represent and warrant that you are:
- At least 18 years of age (or the legal age of majority in your jurisdiction)
- A resident of a jurisdiction where BiryaniHub operates
- Legally capable of entering into binding agreements
- Not prohibited by law from using the Platform
2.2 Account Ownership
- Each account is personal and non-transferable
- You are solely responsible for all activities conducted through your account
- You may not share your account credentials with others
- You may not use the Platform on behalf of another person unless you have explicit authorization
2.3 Prohibited Users
The following individuals cannot use BiryaniHub:
- Individuals under 18 years of age
- Individuals with a history of fraud or dishonest behavior on food platforms
- Individuals prohibited by law from ordering alcohol (if applicable)
- Individuals who have been permanently banned from BiryaniHub
- Vendors or their employees using customer accounts to place test orders
3. ACCOUNT REGISTRATION AND CONTACT INFORMATION
3.1 Email and Phone Number Requirements
To register on BiryaniHub, you must provide:
Email Address Requirements:
- A valid, active email address that you personally own and check regularly
- Emails must follow standard format (e.g., example@domain.com)
- Disposable/temporary email addresses are NOT accepted (mailinator.com, 10minutemail.com, etc.)
- You must confirm ownership by clicking the verification link sent to your email within 24 hours
- Failed verification attempts may result in registration rejection
Phone Number Requirements:
- A valid, active phone number where you can receive SMS messages or phone calls
- Must be in a format recognized by our system for your country/region
- Must be a number you personally own and have access to
- Used for:
- Order updates and delivery notifications
- Account security (two-factor authentication, if enabled)
- Contacting you regarding orders
- Recovery of your account if you forget your password
- BiryaniHub will verify your phone number via OTP (One-Time Password) during registration
3.2 Contact Information Accuracy
You agree to:
- Provide accurate, current email and phone information
- Update your contact details immediately if they change
- Maintain access to the email and phone number on file
- Respond promptly to verification requests or communications from BiryaniHub
- Accept responsibility for any orders placed if you provided incorrect contact information
3.3 Multi-Device Access
Your account may be accessed from multiple devices using your login credentials. However:
- You remain responsible for all activity on your account
- If you suspect unauthorized access, change your password immediately
- Notify BiryaniHub of suspected account compromise within 24 hours
4. ACCOUNT SECURITY AND PASSWORDS
4.1 Password Requirements
Your password must:
- Be at least 8 characters long
- Contain a mix of uppercase, lowercase, numbers, and special characters
- Not be a common or easily guessable password
- Not be the same as your email or phone number
- Be unique (not used on other platforms, if possible)
4.2 Password Security Obligations
You agree to:
- Keep your password confidential and not share it with anyone
- Change your password if you suspect unauthorized access
- Use a secure, private device when accessing your account
- Log out after using shared or public computers
- Not provide your password to BiryaniHub support (we never ask for it)
4.3 Account Recovery
If you forget your password:
- Use the "Forgot Password?" link to reset it via email or phone verification
- You will receive instructions on the email or phone number on file
- Complete the verification process within the timeframe specified
- Create a new password following the security requirements above
5. CUSTOMER RESPONSIBILITIES AND CONDUCT
5.1 Lawful Use
You agree to use the Platform only for legal purposes and in accordance with all applicable laws. You will not:
- Use the Platform for illegal activities or to order prohibited items
- Attempt to defraud vendors, BiryaniHub, or other customers
- Engage in price fixing or collusion with other customers
- Use automated tools, bots, or scripts to manipulate orders or pricing
5.2 Prohibited Conduct
You must not:
- Harass, threaten, or abuse vendors or BiryaniHub staff
- Post hateful, obscene, or discriminatory content in reviews or communications
- Impersonate another person or organization
- Falsely claim that you are a food critic or influencer to receive discounts or free food
- Engage in "review manipulation" (posting fake reviews, coordinated negative campaigns, etc.)
- Share your account credentials or allow unauthorized use
5.3 Fraudulent Activity
Fraudulent behavior includes, but is not limited to:
- Using payment methods that are not yours or are stolen
- Placing orders you don't intend to pay for
- Claiming refunds for orders you actually received and consumed
- Providing false information during registration or payment
- Engaging in chargeback fraud (disputing legitimate charges)
Consequence: First offense results in account suspension; second offense results in permanent ban.
6. ORDERING PROCESS AND PAYMENT
6.1 Order Placement
When you place an order through BiryaniHub:
- You are requesting food from the Vendor, not from BiryaniHub
- The order is confirmed only after the Vendor accepts it
- You agree to pay the order amount including food price, taxes, delivery fees, and service charges
- Prices displayed are in the currency of your region and are final (no price matching after order)
6.2 Valid Payment Methods
You may pay for orders using:
- Credit cards (Visa, Mastercard, American Express, Discover)
- Debit cards
- Digital wallets (Apple Pay, Google Pay, etc.)
- Cash on delivery (where available)
- Stored payment methods on your BiryaniHub account
All card payments are processed securely through Stripe or other authorized payment processors.
6.3 Payment Authorization
By providing payment information, you:
- Authorize BiryaniHub to charge your payment method for the order total
- Confirm you are the authorized user of the payment method
- Accept responsibility for all charges made with your account
- Understand that failed payments will result in order cancellation
6.4 Pricing and Fees
The order total includes:
- Food Price: Cost of items ordered
- Taxes: Applied per applicable local tax rates
- Service Fee: Small percentage charged by BiryaniHub
- Delivery Fee: (If applicable) Charged by delivery partner
- Discounts/Promotions: Applied automatically if eligible (terms apply)
All fees are displayed before you confirm your order. You agree to the total before placing the order.
6.5 Promo Codes and Discounts
- Promo codes are for one-time use unless stated otherwise
- Codes may have minimum order requirements
- Promotions are non-transferable and have expiration dates
- Abuse of promo codes (fraud, credit stacking, etc.) will result in:
- Refund of promotional discount
- Possible account suspension or ban
- Chargeback liability
7. ORDER DELIVERY AND FULFILLMENT
7.1 Order Acceptance and Timing
- Once you place an order, the Vendor has the right to accept or reject it
- If accepted, preparation begins and an estimated ready time is provided
- You should expect delivery within the estimated timeframe ±15 minutes
- Delays may occur due to traffic, high order volume, or unforeseen circumstances
7.2 Delivery Address Requirements
You agree to:
- Provide a complete, accurate delivery address (street, apartment number, landmarks)
- Ensure someone is available to receive the delivery
- Be available within a reasonable timeframe for driver arrival
- Provide clear instructions if your location is hard to find
Important: If your delivery address is incomplete or incorrect:
- BiryaniHub is not responsible for delayed or failed deliveries
- You may still be charged for the order
- You forfeit the right to a refund in such cases
7.3 Food Quality and Condition
Upon delivery, you should:
- Inspect the food immediately
- Check that items match your order
- Verify that food is in acceptable condition and temperature
- Report any issues immediately via the app
If food is:
- Not as ordered (wrong items, missing items)
- Visibly spoiled or contaminated
- Cold or improperly prepared (when freshly made items are ordered)
You may request:
- A replacement order
- A full refund
- Partial refund (in BiryaniHub credits)
Refund requests must be submitted within 2 hours of delivery.
7.4 Food Safety and Allergies
You are responsible for:
- Reviewing all menu item details before ordering
- Checking allergen information displayed by the Vendor
- Communicating any allergies or dietary restrictions in the special instructions
- Confirming that items are safe for your consumption
BiryaniHub and Vendors are not responsible for allergic reactions caused by:
- Failure to read allergen warnings
- Not communicating allergies clearly
- Cross-contamination that occurs during preparation or delivery
8. CUSTOMER REVIEWS AND RATINGS
8.1 Review Posting
You may leave reviews and ratings (1-5 stars) after completing an order. Reviews must:
- Be based on your actual experience with the order and Vendor
- Be truthful and not misleading
- Not contain false, defamatory, or abusive content
- Not reveal personal information about the Vendor or driver
- Not be used to extort discounts or favors from the Vendor
8.2 Prohibited Review Content
You must not post reviews that:
- Are fake, fabricated, or paid for
- Are posted by someone other than the actual customer
- Contain threats, harassment, or abusive language
- Promote competing restaurants or services
- Attempt to manipulate ratings or rankings
- Violate someone's privacy or defame them
8.3 Review Removal and Consequences
BiryaniHub may remove reviews that violate these terms. If you post prohibited content:
- First offense: Review removal and warning
- Second offense: 30-day posting suspension
- Third offense: Permanent review posting ban or account suspension
9. REFUNDS AND DISPUTE RESOLUTION
9.1 Refund Eligibility
You may request a refund only if:
- Your order was not delivered (after 60 minutes past the estimated time)
- Food was significantly different from what was ordered
- Food arrived cold, spoiled, or in unacceptable condition
- The Vendor cancelled the order without valid reason
- Payment was processed twice for the same order
9.2 Refund Timeline
- Refund requests must be submitted within 2 hours of delivery
- Refunds are processed within 5-7 business days
- Refund is issued to the original payment method
- For cash payments, a credit is issued to your BiryaniHub account
9.3 Non-Refundable Situations
You are not eligible for a refund if:
- You changed your mind about the order
- You failed to be available for delivery
- You ate most of the food and then complained
- You did not communicate special instructions clearly
- Delays were caused by traffic or circumstances beyond the Vendor's control
- You received food in acceptable condition but now claim quality issues
9.4 Dispute Resolution Process
Step 1: Contact the Vendor
- Use the in-app chat to contact the Vendor within 2 hours of delivery
- Provide photos or video evidence of the issue
- Give the Vendor 24 hours to respond and attempt resolution
Step 2: Escalate to BiryaniHub
- If the Vendor does not respond or refuses to help, contact BiryaniHub support
- Provide documentation: order details, photos, communications
- Include the Vendor's response (or lack thereof)
Step 3: BiryaniHub Investigation
- BiryaniHub will review all evidence
- May request additional information from you or the Vendor
- Decision will be made within 5 business days
- You will be notified of the outcome via email/app
Step 4: Final Appeal (if applicable)
- If you disagree with BiryaniHub's decision, you may appeal once
- Submit new evidence or documentation
- Final appeal decision is binding
9.5 Chargeback and Payment Disputes
If you dispute a charge with your bank/payment processor:
- BiryaniHub will defend the transaction with order records
- If the chargeback is ruled in your favor, your account may be suspended
- Repeated chargebacks will result in permanent account termination
- You may be liable for chargeback processing fees
10. DATA PRIVACY AND SECURITY
10.1 Information We Collect
During registration and use, BiryaniHub collects:
- Personal information: name, email, phone number, date of birth
- Account data: password (hashed), login history, account activity
- Location data: delivery addresses, GPS location (if enabled)
- Payment information: card details processed by Stripe (BiryaniHub does not store full card numbers)
- Order history: items ordered, prices paid, delivery details
- Communication data: messages with Vendors, support tickets
- Device data: IP address, browser type, device information
- Analytics: how you use the Platform (pages visited, features used)
10.2 How We Use Your Information
Your information is used for:
- Processing orders and deliveries
- Account management and customer support
- Personalizing your experience (recommendations, saved addresses)
- Fraud detection and prevention
- Complying with legal and tax requirements
- Marketing communications (if you opted in)
- Improving the Platform and services
10.3 Data Sharing
BiryaniHub shares your information with:
- Vendors: Order details necessary to prepare and fulfill your order
- Delivery Partners: Name, phone number, address, order details for delivery
- Payment Processors: Card information (processed by Stripe)
- Service Providers: Analytics, hosting, customer support platforms
- Legal Authorities: When required by law (court orders, subpoenas)
We do NOT sell or rent your personal information to third parties.
10.4 Data Security
BiryaniHub implements:
- Encrypted data transmission (HTTPS/SSL)
- Secure password hashing
- Regular security audits and penetration testing
- Access controls to limit employee access to personal data
- Data breach response procedures (notification within 48 hours)
However, no system is 100% secure. You acknowledge risks of online transmission.
10.5 Your Privacy Rights
You have the right to:
- Access your personal information by requesting it in the app or via support
- Update or correct your information at any time
- Delete your account and associated data (except as required by law)
- Opt out of marketing communications (while keeping essential order/account emails)
- Request what data BiryaniHub has collected about you
11. LIMITATION OF LIABILITY
11.1 BiryaniHub's Role
BiryaniHub is a platform provider, not a restaurant or food service provider. We:
- Do not prepare, cook, or serve food
- Do not employ delivery personnel (they are independent contractors)
- Are not responsible for Vendor conduct or food quality
- Are an intermediary connecting customers with Vendors
11.2 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- BiryaniHub provides the Platform "AS IS" without warranties of any kind
- We do not guarantee:
- Uninterrupted service (technical outages may occur)
- Food quality or safety (responsibility lies with the Vendor)
- Punctual delivery (subject to external factors)
- Availability of specific menu items
- Accuracy of restaurant information or hours
11.3 Limitation of Damages
BiryaniHub's total liability to you shall not exceed:
- The total amount you paid for the specific order in dispute
- For repeated issues, the maximum is your total spending in the past 90 days
BiryaniHub is not liable for:
- Indirect or consequential damages (lost time, inconvenience, emotional distress)
- Food poisoning or illness (direct liability rests with the Vendor)
- Accidents or injuries caused by delivery personnel
- Loss of business or missed events due to order delays
- Damage to property from food delivery
12. INDEMNIFICATION
You agree to indemnify and hold BiryaniHub harmless from any claims, damages, losses, or expenses arising from:
- Your breach of these Terms
- Your use of the Platform in violation of applicable law
- Your disputes with Vendors regarding food quality or service
- Your actions toward delivery partners (harassment, refusal to accept delivery, etc.)
- Intellectual property claims related to your account or content
- Any injury or illness related to food you received
13. ACCOUNT SUSPENSION AND TERMINATION
13.1 Reasons for Suspension or Termination
BiryaniHub may suspend or terminate your account if you:
- Violate these Terms or any applicable laws
- Engage in fraudulent activity or chargebacks
- Harass or abuse Vendors, delivery partners, or BiryaniHub staff
- Repeatedly place orders and then dispute charges falsely
- Use multiple accounts to circumvent limits or fraud prevention
- Have an outstanding balance or unpaid invoices
- Engage in review manipulation or fake reviews
- Attempt to hack or manipulate the Platform
13.2 Suspension vs. Termination
- Suspension: Temporary (7-30 days), allows account to be reactivated
- Termination: Permanent ban from the Platform
13.3 Appeal Process
If your account is suspended or terminated:
- You will receive email notification with the reason
- You may appeal within 30 days by contacting support
- BiryaniHub will review your appeal
- The decision is final and binding
13.4 Post-Termination
Upon termination:
- Your account is deleted and cannot be recovered
- You cannot create a new account (this is a permanent ban)
- Any account balance or credits are forfeited
- You cannot use the Platform or contact Vendors through it
14. MODIFICATIONS TO TERMS
14.1 Right to Change
BiryaniHub reserves the right to modify these Terms at any time. Changes are effective:
- For new customers: Upon registration
- For existing customers: 30 days after posting updated Terms
14.2 Continued Use = Acceptance
If you use your account after the 30-day notice period, you are deemed to have accepted the changes.
14.3 Material Changes
For material changes that negatively affect your rights, BiryaniHub will:
- Provide at least 60 days written notice
- Allow you to terminate your account without penalty if you disagree
15. THIRD-PARTY SERVICES
15.1 Payment Processors
- Stripe and other payment processors handle card information securely
- Their privacy policies and terms also apply to payment processing
- BiryaniHub is not liable for payment processor errors or security issues (but will advocate for you)
15.2 Delivery Partners
- Delivery is provided by independent contractors, not BiryaniHub employees
- Delivery partners are bound by their own terms of service
- BiryaniHub is not liable for delivery partner conduct, but will investigate complaints
15.3 Third-Party Links
- BiryaniHub may display links to external websites or services
- BiryaniHub is not responsible for external content or services
- Review their terms and privacy policies before using
16. INTELLECTUAL PROPERTY
16.1 BiryaniHub Content
- The Platform, design, logo, and content are owned by BiryaniHub
- You are granted a limited license to use the Platform for personal ordering
- You cannot reproduce, modify, distribute, or resell BiryaniHub materials
16.2 Your Content
- Reviews, ratings, photos, and comments you post are owned by you
- You grant BiryaniHub a worldwide, royalty-free license to use and display your content
- BiryaniHub may use your reviews in marketing without your additional permission (but not your name/identifying info, unless you agree)
17. DISPUTE RESOLUTION AND GOVERNING LAW
17.1 Informal Resolution
Before legal action:
- Contact BiryaniHub support at support@biryanihub.co
- Describe your issue in detail with supporting documentation
- Allow 30 days for BiryaniHub to attempt resolution
17.2 Mediation
If informal resolution fails, you may request non-binding mediation before pursuing legal action.
17.3 Governing Law

If any provision is found unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable. All other provisions remain in full force.
